Terms of Service

These are the terms you agree to by using MoNote. The short version: the journal is yours, we will not read it or rewrite it, the app is not a doctor, and you can leave whenever you like and take everything with you.
1. Who you are agreeing with
MoNote is operated by Viacheslav Apasov Pr Racunarsko Programiranje Beograd, preduzetnik, registered in Serbia at Zivka Petrovica 52a (company number 66878112). "We" and "us" mean that business; "you" means you.
By installing or using MoNote you accept these terms. If you do not, do not use it.
2. What MoNote is
A voice journal. You record what you want to remember; the app transcribes it, splits one recording into separate notes, files them by topic and by who they are about, and lets you search or ask questions about them later.
2.1 What it is not — and this one matters
MoNote is not a medical device and does not give medical advice. It records what was said. It does not diagnose, does not interpret, does not advise, and is not a substitute for a doctor, pharmacist, nurse or any other professional.
Transcription and note-writing are done by machine and will sometimes be wrong — a misheard dose, a temperature on the wrong day. Do not rely on MoNote for anything where being wrong matters without checking the original recording, which is why the app keeps it. Any decision you make about health, medication or care is yours and should be taken with a qualified person.
3. Your journal
MoNote currently has no accounts. Your journal belongs to the device it was made on, identified by a token stored on that phone. If you lose the phone, you lose the journal — we cannot recover it, because we have no way to know it was yours. Export from time to time (Settings → Your words).
You are responsible for keeping your device secure.
4. Your content stays yours
Everything you record and everything the app writes from it is yours. You keep all rights to it. You give us only the narrow permission needed to run the service — to store your recordings, send them to our processors for transcription and note-writing, and show them back to you.
We do not use your content to train models, ours or anyone else's, and our processors are contractually barred from doing so. We do not read your journal except where you have asked us to look at a specific fault.
That permission ends when you delete your data.
5. Using it reasonably
Do not use MoNote to:
- record people unlawfully — recording laws differ by country and are yours to observe;
- break the law, or store material that is unlawful to hold;
- attack, overload or reverse-engineer the service, or work around its limits;
- resell it or run it on someone else's behalf as a service.
We apply rate and length limits to keep the service standing. They are described in the app where they affect you.
6. Free and paid
6.1 The free plan
Free includes a limited number of recordings per day and per month, and a shorter maximum recording length. The app tells you the shape of the plan when a limit applies. We may change these limits; if a change makes the free plan materially worse we will say so in the app first.
6.2 MoNote Pro
Pro is an auto-renewing subscription, monthly or yearly, at the price shown in the app for your country.
- Payment is taken by Apple or Google, not by us. We never see your card.
- Your subscription renews automatically unless cancelled at least 24 hours before the end of the current period.
- Cancel any time in your App Store or Google Play account settings. Cancelling stops the next renewal; the period you have paid for runs to its end and you keep Pro until then.
- Refunds are handled by Apple and Google under their own policies, because they took the payment. We cannot issue a refund for a store purchase.
- Where the law gives you a right of withdrawal — including the 14-day right for consumers in the EU and UK — that right applies and is exercised through the store.
We may change prices. An existing subscription keeps its price until you cancel; a change applies from the next renewal and the stores will notify you as their rules require.
7. Availability
We try to keep MoNote running and make no promise that it always will. It depends on services we do not control, and it may be unavailable for maintenance, faults or things outside our hands. Recording works without a connection; transcription and note-writing do not.
We may change or discontinue features. If we discontinue the service altogether we will give reasonable notice and time to export.
8. Ending it
You may stop at any time by deleting your data in Settings and removing the app. Deletion is immediate and complete.
We may suspend or end access if you materially break these terms — for example by attacking the service — and where it is reasonable we will warn you first.
9. Disclaimers and liability
To the extent the law allows, MoNote is provided "as is", and we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement.
To the extent the law allows, we are not liable for indirect or consequential loss, or for lost data or profit; and our total liability for any claim is limited to what you paid us in the twelve months before it arose.
Nothing here limits liability that cannot lawfully be limited — including for death or personal injury caused by negligence, for fraud, or under mandatory consumer-protection law where you live. If you are a consumer in the EEA or the UK, you keep every statutory right these terms cannot take away, and nothing here overrides them.
10. Law and disputes
These terms are governed by the law of the Republic of Serbia, and the courts of Serbia have jurisdiction.
If you are a consumer, this does not deprive you of the protection of the mandatory law of the country where you live, and you may bring proceedings in your own local courts. Consumers in the EU may also use the European Commission's online dispute resolution platform.
11. Changes to these terms
We may update these terms. If a change matters to you we will say so in the app before it takes effect. Continuing to use MoNote after that means you accept the new version; if you do not, delete your data and stop using it.
12. If you installed MoNote from the App Store
Apple is not a party to these terms. They are between you and us. Apple distributes the app and takes the payment; what the app does with what you say is ours to answer for.
Two documents, and this is the one about the service. The software itself is licensed to you under Apple's standard Licensed Application End User License Agreement — the Terms of Use (EULA) linked from our App Store page, which covers your licence to run the app on your Apple devices. This document covers everything else: your journal, your content, what we will and will not do with it, and how Pro renews and is cancelled (section 6.2).
Support and any claim about the app are ours, not Apple's. Apple has no obligation to support MoNote. Any question, complaint or claim — including product liability, a legal or regulatory requirement, consumer protection, privacy, or a claim that MoNote infringes someone's intellectual property — comes to us, at hello@monote.me. Refunds are the exception, because Apple took the payment: see section 6.2.
